The Supreme Court, in a historic move today, has decriminalised homosexuality, restoring a landmark Delhi High Court judgement.
A five-judge bench led by CJI Dipak Misra diluted Section 377 of the Indian Penal Code, to exclude all kinds of adult consensual sexual behaviour. The law will still stand on the statute book to deal with unnatural sexual offences against minors and animals.
CJI Dipak Misra said,
“Section 377 is irrational, arbitrary and incomprehensible as it fetters the right to equality for LGBT community. LGBT community possesses same equality as other citizens.”
The decision was immediately hailed by the minority LGBT community and even the Film fraternity came in support and bid adieu to this discriminating law. Check out what the B-Town stars had to say:
“If you have a heart you should be free to love who you want.” ❤️So Happy to hear that the Supreme Court of India has abolished #section377 decriminalising Homosexuality #equality #lgbtrights #nodiscrimination #ting pic.twitter.com/47yEBdkul7
